Ottawa sociology professor and terror suspect Hassan Diab is expected to seek bail.
Diab is wanted in France in connection with the 1980 bombing of a Paris synagogue that killed four people and injured dozens of others and Thursday the Ontario Court of Appeal upheld a decision that he should be extradited.
Diab's lawyer, Donald Bayne said they would ask for Diab to be released from custody.
"He's been a superb performer on bail for five and a half years," said Bayne. "He's not a risk either of flight or the commission of any offences."
Bayne said the evidence against his client is unreliable and had his case been heard in British Columbia's Court of Appeal -- based on their past rulings in similar cases -- Diab would likely already be a free man.
Bayne said they would take his case to the Supreme Court of Canada.
